Dalam sidang dipimpin majelis hakim Masrimal SH, dengan agenda tuntutan yang diungkapkan oleh Jaksa Penuntut Umum (JPU) Armen Wijaya SH, bahwa perbuatan yang dilakukan terdakwa Mardali Yakup dikarenakan terbukti bersalah melakukan tindak pidana memiliki, menyimpan dan menguasai narkotika golongan 1 jenis tanaman, sebagaimana diatur dan diancam dalam dakwaan pertama pasal 112 ayat (1) UU nomor 35 tahun 2009 tentang Narkotika.
“terdakwa Mardali Yakup dituntut dengan pidana penjara selama enam tahun dan enam bulan penjara dikurang selama terdakwa berada dalam tahanan sementara dengan perintah terdakwa tetap ditahan,” kata Armen.
JPU Armen, juga menambahkan terdakwa Mardali Yakup juga dibebani membayar pidana denda sebesar 800 juta subsider 6 bulan kurungan penjara, “untuk dua butir pil ekstasy dengan berat keseluruhan 0,548 gram dan satu unit handpone Blackberry warna putih dirampas untuk dimusnakan,”katanya.
Untuk proses hukum diruang sidang PN Palembang, majelis hakim Masrimal menunjuk penasehat hukum dari negara untuk mendampingi terdakwa Mardali Yakup, ketentuan tersebut berdasarkan pasal 56 ayat (1) KUHAP, terdakwa wajib didampingi penasehat hukum untuk menjalani proses sidang dikarenakan ancaman hukuman terdakwa diatas lima tahun.

Selain itu majelis hakim Masrimal SH, usai mendengarkan dakwaan tuntutan JPU serta keterangan saksi-saksi yang hadir dimuka persidangan, memutuskan bahwa sidang yang digelar akan dilanjutkan hingga pekan depan. “Sidang akan dilanjutkan dengan agenda putusan,” kata Masrimal.
Awal kejadian pelaku diamankan oleh anggota kepolisian narkoba Polda Sumsel berdasarkan informasi dari masyarakat bahwa di pelataran parkir diskotik Darma Agung Jalan Kolonel H Burlian Kelurahan Sukarami, Kecamatan Sukarami Palembang, informasi yang didapat bahwa maraknya peredaran dan penjualan narkoba jenis pil ekstasy, setelah dilakukan penyelidikan serta penggeledahan, pelaku langsung diringkus berdasarkan barang bukti yang ada berupa narkoba jenis pil ekstasy.
